Right of Withdrawal

If you are a consumer and a statutory right of withdrawal applies to your purchase, you have the right to withdraw from the contract within 14 days without giving any reason.

For goods, the withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, receives the goods.

If your order contains multiple items delivered separately, the withdrawal period begins on the day on which you receive the last item.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement.

You can exercise your right of withdrawal electronically by using the “Withdraw from Contract” function provided in our online shop.

You may also use the model withdrawal form provided below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you submit your withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from the contract, the seller will reimburse all payments received from you, including the cost of the least expensive standard delivery offered, without undue delay and no later than 14 days from the day on which notification of your withdrawal is received.

The seller may withhold reimbursement until the goods have been received back or until you have provided evidence that you have returned the goods, whichever occurs first.

Unless expressly agreed otherwise, reimbursement will be made using the same payment method that you used for the original transaction and without additional charges to you.

You must return the goods without undue delay and no later than 14 days from the day on which you notify us of your withdrawal.

You are responsible for the direct costs of returning the goods.

Please do not send returns to the seller’s address in Switzerland unless expressly instructed to do so.

You may inspect and try on an item to the extent reasonably necessary to establish its nature, characteristics, fit and functioning.

You may be liable for any diminished value of the goods resulting from handling or use beyond what is necessary for such an inspection.

Made-to-Order Products

Most products in the TomTom Online Shop are produced only after your order has been placed. This allows us to avoid unnecessary stock and overproduction.

Please choose your size carefully and check the Size Chart provided before placing your order.

Production on demand alone does not exclude a statutory right of withdrawal where such a right applies.

For non-personalized made-to-order products, your statutory right of withdrawal therefore remains unaffected where applicable.

However, we do not offer an additional voluntary return or size exchange beyond your statutory rights.

If you exercise your statutory right of withdrawal because, for example, you selected the wrong size or the item does not fit as expected, you are responsible for the direct costs of returning the goods.

Please keep in mind that every made-to-order product is manufactured specifically after your order has been placed. We therefore encourage you to carefully check the product information, Size Chart, colour and available options before ordering.

Personalized Products

The statutory right of withdrawal does not apply where the applicable legal requirements for an exemption are met, in particular to products that are made according to your individual specifications or are clearly personalized for you.

This may include, for example, products individually customized with a name, individual text or another customer-specific design.

Where a product is individually personalized, this will be indicated where applicable before purchase.

This does not affect your statutory rights if an item is defective, damaged or incorrectly supplied.

Damaged, Defective or Incorrect Items

Please inspect your order after delivery.

If an item arrives damaged, has a printing, embroidery or manufacturing defect, or you receive an incorrect item, please contact us as soon as possible and include your order number and, where helpful, photographs showing the issue.

Your statutory rights against the seller, Martin Bachmann IT-Consulting GmbH, in relation to defective, damaged or incorrectly supplied goods remain unaffected.

No Additional Voluntary Return or Exchange Period

We do not offer an additional voluntary return or exchange period beyond your statutory rights.

In particular, we do not offer a separate voluntary size exchange for made-to-order products.

This does not limit your statutory right of withdrawal where applicable or your statutory rights relating to defective, damaged or incorrectly supplied goods.
